Apple wins $1.05bn from arch rival Samsung in patent case

The nine-person jury in San Jose, California, found Samsung infringed six of the seven Apple patents in dispute and did so willfully in five of the cases. The jurors also upheld the validity of all seven of Apple patents, many of which covered the design of the iPhone.

Samsung, in turn, counter-sued, claiming that the Californian company infringed five of its own patents. Lawyers for the South Korean company argued Apple was trying to thwart legitimate competition.

"In a very real sense, it's a fight between Apple and Google," said Brian Love, a patent expert at the University of Santa Clara who followed the case. "This particular case has been the most important in that because we have had the number one and the number two manufacturers facing off."

The jurors reached a verdict after less than three days of deliberation, surprising some given the complexity of the case. Judge Lucy Koh, who presided over the case, asked the nine-person jury to address more than 600 questions in their deliberation.

Experts said last night that it remained unclear the effect of the verdict on the other legal battles the two companies are waging outside of the US. Yesterday, a South Korean judge ruled that Samsung did not infringe the design of Apple's phones but had copied a functional design.
